Sending a notice
Under 17 U.S.C. 512(c)(3), a notice of claimed infringement must be in writing and include:
- Your physical or electronic signature (or that of someone authorized to act for the owner).
- Identification of the copyrighted work you say was infringed (or a representative list if several works are on one page).
- The exact address (URL) on gaymoves.com of the material you say infringes, so we can find it.
- Your name, address, telephone number and email.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner.
Knowingly misrepresenting that material is infringing can make you liable for damages. Consider whether the use might be fair use before you send a notice.
What we do
- We review a complete notice, promptly remove or disable access to the material, and tell the person who posted it.
- That person may send a counter-notice if they believe the removal was a mistake. It must include their signature, identification of the removed material and where it appeared, a statement under penalty of perjury of good-faith belief it was removed by mistake or misidentification, their name, address and phone, and consent to the jurisdiction of the federal court for their address (or, outside the United States, any district where we can be found).
- We send the counter-notice to the complainant. Unless they tell us within 10 business days that they have filed a court action, we may restore the material in 10 to 14 business days.
Repeat infringers
We close the accounts of users who are repeat infringers, in appropriate circumstances.
